The Ohio Supreme Court, however, held that the AWW “includes wages for the year preceding injury without qualification or exclusion.” In addition, the law already prohibits paying benefits “when work within the physical capabilities of the employee is made available by the employer or another employer.” Finally, it said that was not unfair to base the AWW on the total wages earned when injury at one job causes the employee to lose wages from other jobs as well.
